Understanding and Protecting IP in Immersive Technologies

Earlier this year Eirmersive hosted a members-only Lunch and Learn webinar exploring the vital topic of Intellectual Property (IP) in the immersive technology space. Led by legal expert Gemma Forde of Byrne Wallace Shields (and Eirmersive Director) and entrepreneur Declan Fahy co-founder at HoloToyz (an Eirmersive member) the session offered both theoretical and practical insights into how IP can be developed, protected, and leveraged for growth.

🔍 What Was Covered

1. Types of IP Explained Gemma Forde broke down the key categories of IP relevant to creative and immersive industries:

  • Copyright: Protects original works like code, music, and visual content.

  • Trademarks: Safeguard brand identifiers such as logos and slogans.

  • Patents: Cover novel inventions and technical processes.

  • Industrial Designs: Protect the aesthetic aspects of products.

  • Trade Secrets: Include confidential business information and know-how.

2. Copyright & Trademarks in Practice Gemma clarified how copyright automatically applies upon creation and how trademarks can be registered or acquired through consistent use. She emphasised the importance of distinguishing between employee and contractor-created works when determining ownership.

3. Licensing as a Growth Strategy The session explored how IP can be commercialised through licensing agreements—whether exclusive or non-exclusive—and how these arrangements can generate revenue and protect innovation.

🧸 HoloToyz Case Study: IP in Action

Declan Fahy shared the journey of HoloToyz, a startup bringing augmented reality to children’s toys. Key takeaways from their experience:

  • IP was central to securing investment and building partnerships.

  • Copyright protection was used for their app code, animations, and creative assets.

  • Strategic licensing with major brands like Paramount helped scale their reach.

  • IP served not just as legal protection but as a core business strategy.

💡 Practical Advice for Startups

Both speakers offered actionable guidance:

  • Map your IP: Identify what you own and how it’s protected.

  • Use NDAs: Safeguard trade secrets and confidential information.

  • Register early: Trademark your brand elements as soon as feasible.

  • Seek expert help: Especially when navigating complex areas like software licensing or patent eligibility.

📣 Final Thoughts

This webinar provided Eirmersive members with a clear roadmap for navigating IP in the immersive tech space. Whether you're building a new product, creating content, or scaling a startup, understanding your IP rights is essential to protecting your innovation and unlocking long-term value.
